Attorney-review draft — not legally approved
This document has been drafted but has not been reviewed by a lawyer. It is published here so you can see our intent and so counsel can review it. It is not a final agreement, and EveryContact Technologies, Inc. does not represent it as legally approved or enforceable.
Refund and Cancellation Policy
How cancellation works and when a refund is given.
Draft prepared for review · EveryContact Technologies, Inc.
Cancelling
You can cancel at any time from your dashboard. Your subscription continues until the end of the period you have already paid for, and then stops.
Cancelling does not immediately delete your data. You can export conversations, leads and appointments while the subscription remains active, and data is retained for the applicable retention period afterwards.
Refunds
Monthly subscriptions: we do not generally refund a partial month, because provider costs (phone numbers, messaging, AI usage) are incurred during it.
Annual subscriptions: within 14 days of the initial purchase, we will refund the annual payment less any usage-based provider costs already incurred. After 14 days, annual subscriptions are not refundable, but you may cancel to prevent renewal.
Where the service has materially failed to perform as described, contact us. We would rather resolve it than argue about a refund.
[ATTORNEY REVIEW REQUIRED: whether this policy complies with applicable consumer protection and auto-renewal statutes in target states.]
Downgrades
Downgrades take effect at the end of the current period. No refund or credit is given for the difference in the current period, because you retain the higher plan’s capacity for its duration.
Suspension for non-payment
We will notify you of a failed payment and retry. Suspension is not a cancellation, and reactivating restores your account and data.
Disputes
If you believe a charge is wrong, contact us before filing a chargeback — we can usually resolve it faster. Where a chargeback is filed, we retain the records needed to respond.
Open questions for counsel
Published deliberately. These are the points we know we cannot resolve ourselves, listed so a reviewer can start with them rather than discover them.
- Whether the 14-day annual refund window and the usage-cost deduction are enforceable.
- Auto-renewal notice requirements by state, including advance-notice timing for annual renewals.
- Whether the no-partial-month-refund position is enforceable for consumers vs. businesses.
